HRC 53: Resolution on the human rights situation of migrants - 13 July 2023

Resolution adopted with no vote

The Human Rights Council this afternoon adopted a resolution on the human rights of migrants.

As for the human rights of migrants: prevention and accountability for human rights violations in transit, the Council called upon States to ensure that their migration legislation, policies and practices were consistent with international human rights law.  The Office of the High Commissioner was requested to convene a half-day intersessional panel discussion on avenues to address human rights violations and abuses against migrants in transit, with a report on that panel to be presented to the Council at its fifty-seventh session. 

In a resolution (A/HRC/53/L.18) on the Human rights of migrants: prevention and accountability for human rights violations in transit, adopted without a vote (as orally revised), the Council calls upon States to ensure that their migration legislation, policies and practices are consistent with international human rights law, and to promote the enjoyment of human rights by all migrants without discrimination of any kind which could result in death, disappearances, violence; to work with national human rights institutions, and other relevant stakeholders to address human rights violations against migrants in transit; to adopt measures to prevent deaths, disappearances, acts of torture, violence and ensure that all human rights violations are subject to independent and transparent investigations and that perpetrators are held accountable; and to adopt concrete measures to adequately train public officials and others who work in those facilities and in border areas; and the Council requests the Office of the High Commissioner maintain its active engagement with the United Nations Network on Migration as a member of its Executive Committee, to ensure efficiency in mainstreaming human rights in migration governance; to continue its work on promoting and protecting the human rights of all migrants; to convene a half-day intersessional panel discussion on avenues to prevent and address human rights violations and abuses against migrants in transit and to ensure the meaningful participation of migrants and their family members; to prepare a summary report on the panel discussion and to submit the report to the Council at its fifty-seventh session and to the General Assembly at its seventy-ninth session; and decides to remain seized of the matter.

We thank Mexico for presenting resolution L18, titled Human Rights of Migrants, Prevention and Accountability for Human Rights Violations and Transit.
We appreciate the continuous efforts on this very important initiative and transparent negotiation process.
Lithuania remains convinced that humane and ordinary migration is the only effective way to guarantee human rights protection to migrants.
Lithuania's experience has proven that we should clearly distinguish between regular, irregular and instrumentalised migration.
We are concerned about the sharp increase of irregular and instrumentalised migration and its inherent risks.
We deplore the **** number of criminals, migrants, smugglers and human traffickers that are abusing people on the move, and we condemn exploitation of migrants as tools to exert political pressure.
We would like to emphasise that pushing practises are on the increase and lead to human rights violations.
It would therefore be useful to include this reference in the future resolution.
Lithuania remains committed to working with all stakeholders to prevent human rights violations and abuses against migrants in transit.
We will continue to promote legal migration, fight smugglers and traffickers, provide protection to those in need, address the root causes of migration, and reduce irregular migration.

President, The goal of this resolution is more important than ever before, particularly as the number of international migrants has increased over the past five decades to more than 280 million worldwide.
This resolution rightly aims to enhance the promotion, protection and respect of the human rights and fundamental freedoms of all migrants without discrimination.
We thank Mexico's delegation for leading this resolution and their constructive engagement, taking into consideration the concerns of others we are proud to Co sponsor along with countries from across the globe.
The United States welcomed the first International Migration Review Forum and we look forward to working with regional and international partners to advance safe, orderly, regular and humane migration management that respects the human rights of migrants.
Consistent with the vision of the Global Compact for Migration, we are expanding access to protection and other lawful pathways to the United States, including through refugee resettlement, family reunification, and labour programmes that allow eligible migrants to apply for entry without making the dangerous journey to our border.
It is imperative that migrants, regardless of status and no matter their country of origin, are treated humanely and with dignity.
We urge every delegation to support this resolution.
