HRC57 - Human Rights in Sudan: adoption of resolution L.22 - 09 October 2024

The UN Human Rights Council in Geneva just adopted a resolution extending mandate of the independent international fact-finding mission (FFM) for the Sudan for one year.

The resolution was introduced by the UK, also on behalf of Germany, Norway and the USA.

The situation in Sudan today is appalling. Reference to various human rights violations affecting the population and made by both parties. Would prefer not to have to present this text, but the situation requires the Council’s attention. The people in Sudan needs attention and accountability. The FFM is the only independent and impartial mechanism monitoring the situation as the national mechanism is neither independent, not impartial. Regrets that it would not be possible to achieve consensus with the delegation of Sudan. The government of Sudan may be against the text but the people of Sudan are in favor of it.

Sudan: Referenced the priorities of Sudan for human rights and justice. Referenced the country office of OHCHR and the recent visit of the Expert in July. So why do the main sponsors of this text still want to extend this FFM? The national mechanism presented several reports already. Where is the principle of complementarity here? The national commission of enquiry is the competent one. We should not impose an external mechanism on Sudan. The text is unfair regarding the reality in Sudan and the respective responsibilities. How can a Council resolution use this unjust approach? How can it equate a national army with rebels? Totally rejects this text. Not correct to say that the main sponsors accommodated comments made. The text is only a selection of paragraphs that we cannot accept. The HRC should stop these double standards. We call for a vote and call on all to vote no.

Resolution adopted by 23 in favour, 12 against and 12 abstentions.

on behalf of a core group consisting of Germany,
Norway,
the United States of America and the UK.
I would like to present draught resolution L 22
four years ago.
This council
pay tribute to the exemplary,
non violent
and inspiring popular uprising of the Sudanese people whose call for freedom,
peace
and justice had brought about a fundamental change
in Sudan's political and human rights situation.
The contrast to the situation in Sudan today
could not be more stark.
The senseless,
brutal war that began last year has displaced over 10 million people.
The council's fact finding mission has documented some of
the appalling suffering which Sudan's people have endured.
Women raped and sexually abused people executed because of their ethnicity,
Children recruited as soldiers, indiscriminate shelling in civilian areas.
More recent reporting of attacks by rapid support forces in Al
Fasher and by the Sudanese armed forces in greater Khartoum are horrifying.
Air strikes and shelling by both parties have killed many civilians,
and dozens of young men have reportedly been executed in the streets of
Khartoum
for suspected affiliation
with the RSF.
Mr President,
we would prefer
not to have to present a resolution,
but clearly this situation warrants the council's attention.
We need independent monitoring. We need to document these atrocities.
The people of Sudan need accountability.
It is only then
that lasting peace can be achieved.
The fact finding mission,
the only independent mechanism focused on investigating
the mass violations and abuses across the country, must be renewed.
There's no other international mechanism doing this work
and there is no feasible national alternative.
Sudan's
national committee is neither impartial
nor independent,
and it is being used to silence those who criticise the authority's actions.
Mr.
President,
our core group held consultations and
consulted extensively with all delegations,
including that of Sudan.
On this draught resolution, we took on board many of the suggestions made,
including a number from Sudan.
Unfortunately,
despite our best efforts,
these changes were not enough for the Sudanese authorities,
colleagues,
members of this council.
The situation in Sudan has been
shamefully under reported.
There is already too little information out of the country.
The Sudanese authorities may not be in favour of this resolution,
but the Sudanese people are they want accountability,
they want peace,
they want their future back that showed them today that they are not forgotten and
that we are listening to them by voting in favour of the resolution before us.
