HRC49 Resolution L.12 on Myanmar 01April 2022

The resolution (A/HRC/49/L.12) on the Situation of human rights in Myanmar, was adopted without a vote as orally revised.

The Human Rights Council decided to extend the mandate of the Special Rapporteur on the situation of human rights in Myanmar for a further period of one year, it requested the Special Rapporteur to present an oral progress report to the Council at its fiftieth and fifty-first sessions and to submit a written report to the Third Committee of the General Assembly at its seventy-seventh session and to the Council at its fifty-second session.  It further requests the Special Rapporteur to continue to monitor the situation of human rights in Myanmar and make recommendations on additional steps necessary to address the ongoing crisis.  In addition, it requests the United Nations High Commissioner for Human Rights to monitor and assess the overall situation of human rights in Myanmar; to provide an oral update to the fifty-first session of the Council, a written update at its fifty-third session, to be followed by an interactive dialogue, and a comprehensive report at its fifty-fourth session, also to be followed by an interactive dialogue.  The Council further reiterated the need to establish a country office of the Office of the United Nations High Commissioner for Human Rights in Myanmar.

Last February, when the UK and EU jointly convened a special session of this Council in response to the coup d'etat by the Myanmar military, we were all deeply alarmed at what the future might bring.
A little more than a year on, sadly, our deepest fears have been turned into harsh reality.
Over 1500 people have been killed by the military, with thousands more killed in wider fighting.
Nearly 13,000 people have been arrested and over half a million have been displaced by military operations.
Sadly, this Council knows only too well what appalling atrocities the Myanmar military is capable of committing.
And as the Council Special Rapporteur Tom Andrews made very clear this session, these atrocities continue.
He's documented reports of torture and of sexual violence and of mass killings.
The grave information he has provided must ensure that the international community continues to speak out against the military's sickening behaviour and maintain pressure for it to end.
We wish to express our gratitude to our colleagues in the EU for presenting this resolution once again and for leading negotiations so constructively.
The draught resolution before us rightly condemns last February's coup in the clearest and strongest terms.
It highlights the horrific catalogue of violations which continue to take place, including those against the Rohingya.
It makes clear that all violations and abuses must cease immediately and that the detained civilian political leaders, as well as the thousands of others in arbitrary detention, must be released without delay.
And it extends the much needed mandate of the Special Rapporteur for a further year.
We'd like to thank the EU in particular for the inclusion in the draught of strong wording on the transfer of arms, building on the wording from last year's UN General Assembly resolution.
The sale and transfer of arms to the Myanmar military must stop.
It is clear that weapons provided to the military are responsible for terrible violations against civilians.
These transfers must cease and they must cease immediately.
We have Co sponsored this resolution and we sincerely hope it will be adopted today without a vote.

President, the Republic of Korea would like to thank the European Union for each leadership in presenting draught Resolution.
L12 has already revised more than one year since the military seized power in Myanmar.
My delegation remains deeply concerned over the serious human rights and humanitarian situation on the ground.
The use of violence against the civilians and disproportionate military response have resulted in numerous civilian casualties, which include women and children.
The lack of tangible progress on the Rohingya issue is also worrisome.
Moreover, I'm especially concerned with the ongoing restrictions on the right to freedom of expression, peaceful assembly and association.
Particularly concerning are the increasing reports of violent responses, two dissenting voices, which could further shrink civic space.
In light of this, my delegation strongly believes that this Council should maintain its scrutiny on Myanmar and reiterate in this regard our pool and continue to support for the mandate of the Special Rapporteur on Myanmar.

President, For these reasons, the Republic of Korea fully supports Draught Resolution 12 and hopes that it will be adopted by consensus so that the Council can send with one voice a strong message on this issue.

President, Pakistan shares international concerns over grave human rights violations and systemic discrimination against the Rohingya Muslims and other minorities in Myanmar.
Pakistan has remained supportive of all international and regional initiatives aimed at promoting meaningful national dialogue and concrete steps to address the discrimination against Rohingya Muslims, as well As for realisation of their fundamental rights.
It is in this spirit and without prejudice to Pakistan's position on reference to the Rome Statute in the draught text, we are ready ready to support L12 as orally revised, which we hope will be adopted by consensus.

It's very obvious that the Gambia is going to support this resolution.
Earlier during the session of the HRC, my honourable Minister for Justice addressed the **** level segment and just mentioned the issues in Myanmar.
He had just, of course, returned from The Hague where we were defending a technical issue on whether The Gambia had jurisdiction over the Rohingya issue and the issues going on in Miami.
I'm not going to take much of people's time because other speakers before me have well articulated the challenges that exist in Miami and the need to get this sorted out as soon as possible.
I urge everyone in this room and everyone voting to consider that this issue is one that all of us should agree on.
We cannot sit and watch what is happening to a minority in Myanmar, but in general, the people of Myanmar who have suffered for many years, I think this situation in Myanmar has outlived their support that it should have received long time ago.
So I believe that we should all try and step up on this.
This is a disgrace to all of us who call ourselves human rights defenders to allow this situation to continue to exist in the manner in which it exists.

Therefore, my delegation would like to say it dissociates itself from the consensus of the adoption of this resolution L12 that we are currently considering, and I would like this to be recorded in the report.
