HRC 53: Resolution on violence against women and girls - 14 July 2023

The Human Rights Council this morning adopted a resolution on preventing and responding to all forms of violence against women and girls in criminal justice detention.

As for accelerating efforts to eliminate all forms of violence against women and girls: preventing and responding to all forms of violence against women and girls in criminal justice detention, the Council requested the Office of the High Commissioner to submit to the Council, at its fifty-ninth session, a report on the situation of human rights of women and girls in criminal justice detention, including information on practices and measures to prevent and address violence against women and girls in the context of criminal justice detention.

In a resolution (A/HRC/53/L.5/Rev.1) on Accelerating efforts to eliminate all forms of violence against women and girls: preventing and responding to all forms of violence against women and girls in criminal justice detention, adopted without a vote (as orally revised), the Council calls upon States to take immediate and effective action to prevent and eliminate all forms of violence against all women and girls in criminal justice detention and to take immediate and effective action to respond to all forms of violence against women and girls in detention and to support and protect all victims and survivors; requests the Office of the High Commissioner to submit to the Council, at its fifty-ninth session, an accessible report in plain language and easy to read formats, on the situation of human rights of women and girls in criminal justice detention, including information on practices and measures to prevent and address violence against women and girls in the context of criminal justice detention; and decides to continue its consideration of the issue of the elimination of all forms of violence against women and girls as a matter of high priority, in conformity with its programme of work, at its fifty-ninth session.

Prior to the adoption of the resolution, the Council took action on three amendments to the text

L.33 was rejected by a vote of 11 in favour, 21 against, and 13 abstentions

L.40 was rejected by a vote of 13 in favour, 22 against, and 11 abstentions

L.43 was rejected by a vote of 16 in favour, 22 against, and 8 abstentions

President, on behalf of 72 Co sponsors from all regional groups, I'm honoured to introduce Draught Resolution L5 Rev 1, accelerating efforts to eliminate all forms of violence against women and girls.
Following 8 informal consultations and numerous small group and bilateral meetings.
We've listened and carefully.
We've listened carefully to the views of all delegations from around the world.
We work constructively and in good faith on our text until the final moments.
We have presented a strong and balanced text that reflects a diversity of views and aligns with existing international standards such as the Bangkok Rules and the Nelson Mandela Rules.
We thank all delegations and civil society for the constructive participation.
Mr.
President, regrettably, violence against women and girls remains one of the world's most pervasive violations of human rights.
Worldwide, women and girls in criminal justice detention are at particularly **** risk of sexual and gender based violence and often experience a continuum of violence throughout their life course.
Women and girls in detention are often from marginalised groups such as indigenous women and girls, women and girls with disabilities, and women and girls of African descent.
They are incarcerated for minor and nonviolent crimes related to poverty and are often invisible and forgotten to society, while systemic and widespread violence against women and girls in detention is in fact preventable.
This is why this resolution is so important.
It's the first resolution of the Human Rights Council to specifically focus on preventing and eliminating violence against women and girls in detention.
What is clear is that all countries worldwide can and must do better.
The resolution before the Council is action oriented and calls on States to address the root causes and historical and structural factors that perpetuate violence and detention, including gender inequality, racism, discrimination and poverty.
Take action to divert women and girls away from detention and into age and gender responsive and disability inclusive rehabilitation and reintegration programmes.
Ensure that the human rights of women and girls are promoted and respected and that sexual and reproductive health and reproductive rights are fully realised, including for victims and survivors of sexual and gender based violence.
Work with all relevant stakeholders, including women and girls, who've experienced attention to promote respect, dignity, accountability, equality and non discrimination, and to end impunity and hold perpetrators accountable.

President, while some issues remain contested, we're pleased to have found common ground with the sponsors on one amendment.
We call upon members of the Council to adopt Resolution L5, Rev One as orally revised by consensus, and in doing so, demonstrate their strong commitment to eliminating all forms of violence against women and girls in criminal justice detention.
